Mobile Terms

The Bouquet Casting Co mobile message service (the “Service”) is operated by Bouquet Casting Co. (“Bouquet Casting Co,” “we,” “us,” or “our”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). These Mobile Terms are in addition to and subject to Bouquet Casting Co.’s Terms and Conditions and Privacy Policy, which are incorporated herein by reference. In the event of any conflict, Bouquet Casting Co. shall determine the controlling provision to the maximum extent permitted by law.

We may modify, suspend, restrict, or cancel the Service or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Bouquet Casting Co.’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Bouquet Casting Co. through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology.

Messages may include transactional or service-related communications, including but not limited to order updates, shipping notifications, account alerts, invoice reminders, customer service communications, or other information related to an active order or your relationship with Bouquet Casting Co. Messages may also include promotional or marketing communications, including but not limited to promotions, specials, product announcements, cart reminders, checkout reminders, and other marketing offers.

You understand that you do not have to sign up for promotional SMS in order to make any purchase from Bouquet Casting Co., and your consent to receive marketing text messages is not a condition of any purchase. Your participation in any SMS program is voluntary.

You acknowledge and agree that Bouquet Casting Co. may document your consent through website forms, checkout pages, popups, keyword opt-ins, order forms, written forms, account activity, or other records reasonably maintained by Bouquet Casting Co. or its service providers.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Message frequency may vary depending on your account activity, order status, marketing engagement, and ongoing promotions. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of receiving marketing text messages from the Service at any time by texting the single keyword command STOP or by using the unsubscribe link, where available, in any text message. You may receive a one-time opt-out confirmation text message. Please allow a reasonable period for your opt-out request to be processed. No further marketing messages will be sent to your mobile device after opt-out is processed, unless initiated by you or unless you subsequently opt back in.

Opting out of marketing messages does not necessarily prevent Bouquet Casting Co. from sending you non-marketing, transactional, or service-related text messages relating to an active order, an ongoing customer service matter, account activity, invoices, shipping, or other operational communications, to the extent permitted by applicable law.

If you have subscribed to other Bouquet Casting Co. mobile message programs and wish to cancel, except where applicable law requires otherwise, you may need to opt out separately from those programs by following the instructions provided in the applicable messages or program terms.

Bouquet Casting Co. reserves the right to change any short code, toll-free number, long code, sender ID, or telephone number used to operate the Service at any time. We may notify you of such changes where required or where we deem appropriate. You acknowledge that any messages, including STOP requests, sent to a number or code that has been changed, disabled, reassigned, or is no longer monitored may not be received, and Bouquet Casting Co. will not be responsible for honoring requests made through such messages.

The Service may not be available on all carriers, in all geographic areas, or on all devices. Delivery is subject to effective transmission by your wireless provider and is not guaranteed by Bouquet Casting Co. Wireless carriers supported by the Service are not liable for delayed or undelivered messages.

You agree to provide us with a valid mobile number that you own or are authorized to use. You are solely responsible for keeping your mobile number accurate and up to date. If you change, deactivate, relinquish, or lose your mobile number, you agree to notify Bouquet Casting Co. and, where applicable, re-enroll with your new number. You understand that mobile numbers may be reassigned by carriers, and you accept all risk associated with failing to update your mobile number. Bouquet Casting Co. shall not be liable for messages sent to a number you previously provided if that number is later reassigned or no longer belongs to you.

You agree not to misuse the Service, including but not limited to enrolling a phone number you are not authorized to use, using automated scripts or bots in connection with the Service, interfering with the operation of the Service, or using the Service for any unlawful, abusive, fraudulent, or unauthorized purpose.

To the extent permitted by applicable law, you agree that Bouquet Casting Co. will not be liable for any failed, delayed, misdirected, incomplete, or undelivered messages; any errors in message content; any actions taken or not taken in reliance on the messages or Service; any carrier-related issues; any number reassignment issues; or any interruption, suspension, or termination of the Service.

Any dispute relating in any way to the Service, these Mobile Terms, or any SMS/text messages sent by or on behalf of Bouquet Casting Co. shall be governed by Bouquet Casting Co.’s Terms and Conditions, including any governing law, venue, dispute resolution, and jury trial waiver provisions set forth therein, to the maximum extent permitted by law.
