In the event of any conflict or overlap, these Terms and the incorporated policies shall be interpreted together to provide maximum effect to Bouquet Casting Co.’s protections, rights, and remedies.

Section 1 - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use Bouquet Casting Co.’s products or Service for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction, including but not limited to copyright laws.

By placing an order, you further represent that all information you provide to Bouquet Casting Co. is truthful, complete, and accurate, and that you will comply with all instructions provided by Bouquet Casting Co., including but not limited to those concerning shipping, packing, labeling, timing, item disclosure, approvals, and payment of any outstanding balances.

Bouquet Casting Co. reserves the right to refuse Service to anyone for any reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and involve: (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Bouquet Casting Co. is not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information is not current and is provided for your reference only. Bouquet Casting Co. reserves the right to modify the contents of this site at any time, but has no obligation to update any information on its site. Bouquet Casting Co. may, in its sole discretion, issue additional invoices after an order is placed for add-on products, replacement flowers, bouquet recreation, upgraded services, shipping-related surcharges, excess shipping costs, address correction charges, additional carrier charges, or other order-related costs actually incurred. Client agrees to pay such invoices when due.

Section 5 - Products

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return, exchange, cancellation, or repair only according to Bouquet Casting Co.’s Return & Refund Policy and Shipping Policy.

Bouquet Casting Co. has made every effort to display as accurately as possible the colors and images of Bouquet Casting Co.’s products on the website. Bouquet Casting Co. cannot guarantee that your computer monitor, phone screen, tablet, or other device will display any color, tone, finish, or image accurately.

Bouquet Casting Co. reserves the right, but is not obligated, to limit the sales of Bouquet Casting Co.’s products or Service to any person, geographic region, or jurisdiction. Bouquet Casting Co. may exercise this right on a case-by-case basis. Bouquet Casting Co. reserves the right to limit the quantities of any products or Service that Bouquet Casting Co. offers. All descriptions of products, product pricing, services, and service pricing are subject to change at any time without notice, at Bouquet Casting Co.’s sole discretion. Bouquet Casting Co. reserves the right to discontinue any product or service at any time. Any offer for any product or service made on this site is void where prohibited.

Bouquet Casting Co. does not warrant that the quality of any products, Service, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Client acknowledges that Bouquet Casting Co.’s products are handmade using organic materials and artistic processes. Because flowers and other natural materials change over time and respond unpredictably to drying, preservation, pressing, resin, adhesives, pigments, climate, handling, age, and transport conditions, Bouquet Casting Co. does not guarantee an exact visual outcome, exact color match, exact flower match, exact floral recreation, or exact duplication of fresh bouquet appearance.

White flowers may become translucent or amber; red flowers may deepen in color; bruising, spotting, browning, translucency, mold marks, and other natural changes may become visible after drying or preservation. Minor imperfections, including but not limited to micro-bubbles, layer lines, dust particles, slight asymmetry, edge irregularities, and natural variations in placement or finish, are inherent to the handmade resin and floral preservation process and shall not be considered defects.

Over time, all epoxy resin may naturally amber in color. Ambering, yellowing, fading, oxidation, and other age-related changes should be expected over time with any resin product and do not constitute a defect, misrepresentation, or basis for refund, replacement, or dispute.

Client further acknowledges that dissatisfaction based on subjective preference, including but not limited to artistic interpretation, arrangement, flower placement, design decisions, layout, proportions, color outcome, memento integration, or overall appearance, does not constitute a defect and shall not be grounds for refund, replacement, repair, cancellation, chargeback, or dispute.

Section 5A - Product Photography and Marketing Use

By purchasing from Bouquet Casting Co., Client grants Bouquet Casting Co. the irrevocable, perpetual, worldwide, royalty-free right and license to photograph, film, record, edit, publish, reproduce, display, distribute, and otherwise use images, video, and other visual depictions of the Client’s completed preservation pieces, recreations, floral materials, and related finished products for Bouquet Casting Co.’s lawful business purposes, including but not limited to advertising, promotion, portfolio display, website content, social media, email marketing, printed materials, educational content, editorial use, and other marketing or commercial purposes.

This right includes the exclusive right, in Bouquet Casting Co.’s discretion, to create and use its own product photography, studio photography, styled photography, process photography, and finished-piece imagery of any preservation product created by Bouquet Casting Co. Client acknowledges that Bouquet Casting Co. is not required to credit the Client in connection with such use and that no compensation, royalty, approval right, or additional consent shall be owed to the Client for Bouquet Casting Co.’s use of such images or footage.

Bouquet Casting Co. will make reasonable efforts not to intentionally publish highly sensitive personal information in connection with such marketing use; however, Client acknowledges that finished preservation pieces, floral recreations, and related product imagery may be displayed publicly as part of Bouquet Casting Co.’s portfolio and marketing materials.

To the extent any non-Bouquet Casting Co. copyright or proprietary interest could be claimed by Client in photographs or videos created by Bouquet Casting Co. depicting the finished product, Client assigns and transfers any such interest to Bouquet Casting Co. to the fullest extent permitted by law.

Client further grants Bouquet Casting Co. the right to use, edit, crop, modify, publish, and display any photos, videos, testimonials, reviews, or user-submitted content voluntarily provided to Bouquet Casting Co. in connection with the Client’s order, unless otherwise prohibited by law.

Section 6 - Refunds, Cancellations, and Remedies

All refunds, cancellations, repairs, shipping-related claims, artistic disclaimers, and related remedies are governed by Bouquet Casting Co.’s Return & Refund Policy and Shipping Policy, which are incorporated herein by reference.

Due to the custom, handmade nature of Bouquet Casting Co.’s products and services, and the space, labor, scheduling, materials, drying time, and resources dedicated to each order, Bouquet Casting Co. does not offer refunds, returns, or exchanges except as expressly stated in the applicable policy and solely at Bouquet Casting Co.’s discretion.

Client acknowledges and agrees that Bouquet Casting Co.’s retained deposit amounts, cancellation charges, minimum retained amounts, and other retained funds described in the Return & Refund Policy are agreed-upon liquidated damages and are not penalties.

If work has begun on an order, including but not limited to drying, design preparation, sourcing, pressing, resin work, bouquet recreation, replacement flower sourcing, or other production work, Bouquet Casting Co. reserves the right to deny any cancellation or refund request in whole or in part as set forth in the Return & Refund Policy.

If any issue involves transit damage, late shipment, flower condition, incomplete compliance with instructions, outdated address information, shipping label misuse, carrier delays, non-response, or unpaid balances, such matters shall be governed by the Shipping Policy and Return & Refund Policy.

Repair, replacement, refund, partial refund, or accommodation, if offered at all, shall be Bouquet Casting Co.’s sole and exclusive remedy and shall be provided only at Bouquet Casting Co.’s sole discretion.

Section 7 - Billing and Account Information Accuracy

Bouquet Casting Co. reserves the right to refuse any order you place with Bouquet Casting Co. Bouquet Casting Co. may, in its sole discretion, limit or cancel quantities purchased per person, per household, per event, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, the same billing address, the same shipping address, or the same event.

In the event that Bouquet Casting Co. makes a change to, or cancels, an order, Bouquet Casting Co. may attempt to notify you by contacting the email address, phone number, and/or billing address provided at the time the order was made. Bouquet Casting Co. reserves the right to limit or prohibit orders that, in its sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made on Bouquet Casting Co.’s website. You agree to promptly update your account and other information, including your email address, mailing address, delivery address, and payment information, so that Bouquet Casting Co. can complete your transactions and contact you as needed.

Client acknowledges that Bouquet Casting Co. may issue additional invoices after checkout for order-related balances, including but not limited to add-on items, upgraded services, replacement flowers, bouquet recreation fees, additional shipping charges, carrier surcharges, excess inbound shipping costs, address correction charges, split shipment requests, return shipment charges, or other costs actually incurred in connection with the order. Bouquet Casting Co. reserves the right to place any order on hold, withhold shipment, proceed using best judgment, or otherwise exercise its rights under these Terms and the applicable policies if any such balance remains unpaid.

Any complimentary shipping label, shipping credit, or shipping-related promotion offered by Bouquet Casting Co. is subject to Bouquet Casting Co.’s Shipping Policy and may be limited, denied, revoked, or invoiced back in Bouquet Casting Co.’s sole discretion based on order value, event grouping, shipping destination, proximity to Bouquet Casting Co., business or commercial status, misuse, or noncompliance with Bouquet Casting Co.’s instructions.

Complimentary shipping labels, shipping credits, or shipping-related promotions offered by Bouquet Casting Co. are intended only for qualifying orders as determined by Bouquet Casting Co. in its sole discretion and may be denied, withheld, revoked, or invoiced back for business, commercial, wholesale, referral-partner, florist, funeral home, venue, planner, reseller, bulk, or other non-consumer orders, or for any order that does not satisfy Bouquet Casting Co.’s eligibility requirements under its Shipping Policy.

Section 8 - Cookies

This Agreement shall begin on the date hereof. Certain parts of this website may offer the opportunity for users to post and exchange opinions, information, material, and data. Bouquet Casting Co. reserves the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice, including after you have submitted your order.

Bouquet Casting Co. undertakes no obligation to update, amend, or clarify information in the Service or on any related website except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

To the fullest extent permitted by law, Bouquet Casting Co. shall not be liable for any loss or damage of any nature arising out of or relating to use of the website, any product, any service, any delay, any shipping event, any floral condition issue, any artistic outcome, any non-response issue, any unpaid invoice issue, any third-party service issue, or any other matter addressed by these Terms or the incorporated policies, except as expressly stated by Bouquet Casting Co. in writing.

You agree to indemnify, defend, and hold harmless Bouquet Casting Co. and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, employees, successors, and assigns from and against any claim, demand, action, proceeding, loss, liability, damage, judgment, settlement, fine, penalty, cost, or expense, including reasonable attorneys’ fees, arising out of or relating to:

(b) your violation of any law or the rights of a third party;
(c) your failure to follow Bouquet Casting Co.’s instructions, including shipping, packing, timing, labeling, item disclosure, payment, or address instructions;

(e) any dispute involving your shipment, your contents, your mementos, your address, your requested delivery location, or your requested services; or
(f) any claim brought by a third party arising out of your order, your conduct, or your use of Bouquet Casting Co.’s website or services.

Whenever possible, each provision of these Terms of Service shall be interpreted in such manner as to be effective and valid under applicable law, but if any provision of these Terms of Service is held invalid, unlawful, or unenforceable, the remainder of these Terms of Service shall nevertheless remain in full force and effect, and the invalid, unlawful, or unenforceable provision shall be modified or replaced by a valid and enforceable provision that most closely reflects the original intent.

Section 21 - Turnaround and Production Timing

Turnaround is the time from when an order is submitted and Bouquet Casting Co. receives a Client’s flowers or approved materials to when the Client’s finished product is completed and prepared for shipment. Due to the time required to properly dry, disassemble and reassemble, preserve, press, craft, design, source replacement flowers where applicable, and account for the natural curing times of the resin process, with everything being handmade to Bouquet Casting Co.’s standards, all turnaround times are estimates only.

Standard processing is typically at least 36 weeks from the date Bouquet Casting Co. receives the Client’s flowers or approved materials. During peak season, including generally April through October, timelines may extend beyond 40 weeks due to higher order volume and natural production variability.

Production time varies based on flower thickness, flower condition, order volume, required color restoration, floral recreation needs, design complexity, humidity, curing conditions, staff capacity, material availability, and other operational factors. Time is not of the essence under this Agreement. Delays in production do not constitute breach of contract and do not entitle the Client to refund, cancellation, chargeback, or any other remedy except as expressly provided in Bouquet Casting Co.’s policies.

Bouquet Casting Co. generally processes orders on a first-in, first-out basis, but flower drying times, curing variables, design complexity, and operational considerations may alter the order of completion.

Section 22 - Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms of Service for all purposes.

These Terms of Service are effective unless and until terminated by either you or Bouquet Casting Co. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use Bouquet Casting Co.’s Service, or when you cease using Bouquet Casting Co.’s site, subject always to any payment obligations, cancellation terms, retained deposit amounts, retained liquidated damages, and other surviving obligations set forth in these Terms and incorporated policies.

If, in Bouquet Casting Co.’s sole judgment, you fail, or Bouquet Casting Co. suspects that you have failed, to comply with any term or provision of these Terms of Service, any incorporated policy, or any order-related instruction, Bouquet Casting Co. may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Bouquet Casting Co. may also deny you access to the Service or any part thereof, cancel or suspend your order, hold your shipment, proceed using best judgment, or exercise any remedy available under these Terms and the incorporated policies.

Section 23 - Entire Agreement

The failure of Bouquet Casting Co. to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies, instructions, notices, product pages, operating rules, order forms, shipping requirements, Return & Refund Policy, Shipping Policy, Privacy Policy, Blossom Box terms, BloomSafe terms, and other terms posted by Bouquet Casting Co. on this site or otherwise provided in respect to the Service constitute the entire agreement and understanding between you and Bouquet Casting Co. and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, proposals, or understandings, whether oral or written, between you and Bouquet Casting Co., except where Bouquet Casting Co. expressly agrees otherwise in writing.

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Section 24 - Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws principles.

Clients and Bouquet Casting Co. agree to attempt in good faith to resolve any dispute relating to this Agreement, the website, the products, the services, payments, invoices, shipping, damage claims, cancellations, or any incorporated policy through direct communication first.

If a dispute is not resolved through direct communication, the parties may mutually agree to pursue mediation through a neutral mediator.

If the dispute is not resolved through direct communication or mediation, then any legal action relating to the dispute must be filed exclusively in either:
(a) the Court of Common Pleas of Delaware County, Pennsylvania; or
(b) if federal jurisdiction exists, the United States District Court for the Eastern District of Pennsylvania.

Client consents to personal jurisdiction and venue in those courts and waives any objection based on forum non conveniens or similar doctrine.

CLIENT AND BOUQUET CASTING CO. EACH WAIVE ANY RIGHT TO A JURY TRIAL TO RESOLVE ANY DISPUTE ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE WEBSITE, THE PRODUCTS, THE SERVICES, OR ANY INCORPORATED POLICY.

The prevailing party in any litigation or formal proceeding arising out of or relating to this Agreement shall be entitled to recover from the non-prevailing party its reasonable attorneys’ fees, court costs, and related expenses.

You can review the most current version of the Terms of Service at any time on this page. Bouquet Casting Co. reserves the right, at its sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to Bouquet Casting Co.’s website.

It is your responsibility to check Bouquet Casting Co.’s website periodically for changes. Your continued use of or access to Bouquet Casting Co.’s website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
